Prosecutor says CPD officer acted lawfully in deadly downtown shooting

CLEVELAND, OH (WOIO) -

Cuyahoga County Prosecutor Timothy McGinty announced Thursday that Cleveland Police Officer, Patrolman Rogers Jones, acted within the law when he shot and killed Kenneth Smith back in 2012.

Patrolman Jones has been on restricted duty status since the shooting. Police Internal Affairs Unit will now do an administrative review.

A grand jury has been hearing the case and testimonies since a lawyer for the family filed a lawsuit. They have also been hearing testimony about the deadly police chase from November of 2012.

Smith was shot downtown in March of 2012 by Patrolman Jones, who was off-duty at the time.

CLEVELAND, OH (WOIO) -

Multiple sources confirm a Cuyahoga County Grand Jury has been hearing testimony about another deadly Cleveland police shooting from 2012, the shooting of Kenny Smith.

Smith was shot in March of that year by an off-duty officer in Downtown Cleveland. Police said at the time the officer noticed shots coming from a car in a parking lot. He called dispatch, and when a patrol unit pulled over the car, the off-duty officer shot Smith. Police said Smith refused to get out of the car, and he reached for a weapon.

However, Attorney Terry Gilbert has filed a lawsuit on behalf of the family questioning what happened.
