ELYRIA, Ohio – A Vermilion has man filed a lawsuit in Lorain County Common Pleas Court to get back the engagement ring he gave to his former fiancee.

According to court documents, Daniel Lucas is suing Linda Gerek to get back the $31,625, 2-karat, diamond engagement ring he bought her. The lawsuit states Gerek breached the agreement to marry him and be faithful when she broke off the relationship. The couple had been engaged since July of 2008.

Lucas wants the ring back.

At Vandemark Jewelers in Elyria, happy couples stop in every day to look at engagement rings. Owner Jim Vandemark said the issue of who would get the ring if the relationship is called off comes up from time to time.

“Commonly we find out that if it’s given on any day of the year that’s not a special occasion we’ve been told it’s the property of the person who bought the ring and it’s to be given back if the contract is broken. But if it’s given on a special occasion like a birthday or something like that then it’s a gift for that occasion and the ring belongs to the recipient of the gift,” Vandemark explained.
