The Judging period begins on 10/4/2016 as noted and ends at 11:59 (EST) on 10/6/2016.
HOW TO ENTER:
You may enter by locating the Jack’n for Beats mobile studio unit and requesting an entry at one of the Live Local Auditions in Ohio between 10/4/2016 and 10/6/2016. You must complete the registration/entry form offered by the mobile studio unit staff and perform an entry (16 bars) according to the criteria listed below. To be eligible to participate in the Live Local Audition, Live Local Audition Participant must execute a Liability / Publicity Release and release all Promotion Partners from any claim participant may have for participating.
An entry will be judged immediately by a panel of judges at the Live Local Audition. If your entry is rejected as ineligible, or judged not acceptable due to the Judging Criteria and/or quality, by the judging panel your entry is ineligible and will not be considered.
If the entry you perform is eligible it will be submitted into the contest and you will be entered.
There will be up to two (2) entries selected by the panel of judges at each Live Local Audition to participate in a Live Cypher Event/Grand Finale in that city (‘Cypher Participants”). The Local Cypher Event/Grand Finale will take place on October 7, 2016 at the Grog Shop (2785 Euclid Height Blvd., Cleveland Heights, OH 44106). If a Cypher Participant is not able to attend the Local Cypher Event, he/she forfeits the opportunity to compete in that part of the promotion.
During the Local Cypher Event/Grand Finale, participants will compete in a rotating hip hop cypher. The judges will review and judge the Cypher Participants performance narrowing down contestants to semi-finalists and finalists and at the conclusion of the Local Cypher Event the judges will select one winner of the Local Cypher Event as the Grand Finale Prize Winner. The Local Cypher Event Winner will win a Grand Finale Prize. The Grand Finale Prize is a trip for two to Miami for New Year’s Eve. The Grand Prize Winner will be notified at the Local Cypher Event/Grand Finale.
LIVE LOCAL AUDITIONS
All Live Local Audition entries must be no less than and no greater than sixteen (16) bars in length. An entry must include vocals, but may not consist solely of vocal. Entry must be accompanied by musical instrument sounds provided in the mobile studio. Entry must be Hip Hop (for this Contest, Hip Hop is defined as follows; Lyrical-centric music of the urban genres, that does not primarily feature danceable rhythms or melodic choruses. Vocals and music is required and lyrics must be sung in English). Submission Materials that do not meet the requirements, in the sole judgment of the Sponsor and/or its judging panel will not be eligible.
Submissions must not violate/infringe copyright laws, or other intellectual property rights of any other party; must contain properly cited material, if applicable; and must be previously unpublished, original material and must be suitable for publication.
Limit one entry/submission per person per Live Local Audition.
All attendees to Local Live Auditions are not guaranteed the chance to submit entries. The amount of entries accepted at each Local Live Audition are bound by time.
In addition to all other criteria, your hip hop bar entry must comply with the following. An entry may be rejected for any of the following reasons as determined by the Sponsor in its sole discretion:
Any entries are not of your own creation, have been copy written or trademarked
Contain any mention of other brands within the same Beverage/Alcohol category
References third parties, including celebrities
Submitted in a language other than English
May give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment
No one under 21 years of age
No smoking
Contains or makes any reference to any branded food or beverage products other than Jack Daniels Tennessee Honey
Creates a false identity, or impersonates any person or entity, or falsely states or otherwise misrepresents an affiliation with any person or entity
Any commercial solicitation or advertising
Any use of profanity, sexually content or suggestive expressions or comments, offensive language, “off-color” material or similarly unacceptable language or material
False, misleading, deceptive or exaggerated comments regarding Sponsor or any of its products, or regarding competitors or any of their products
Any harassing, threatening, derogatory, demeaning, defamatory, racist, abusive, hateful, violent or obscene language or material, or discriminatory or prejudicial language or material
Any reference in the written entry to the personal identity of the Entrant including last name, e-mail address, phone number, age or geographical location with the exception of the first name and last initial
Any reference to personal information about others, including name or information that may be used to identify or locate another individual or that could otherwise be deemed to constitute invasion of another’s privacy
Any material that condones or incites violence, bullying or unlawful behavior
Libel, slander or defamation of character of any Entrant or non-Entrant
Any illegal statements, material or content
Any political content or propaganda
Any language that promotes drugs or alcohol, illegal or inappropriate activities or potentially dangerous behavior that may result in harm to anyone reading or viewing the submission
Disclosure of trade secrets, confidential, nonpublic, propriety or privileged information of the Sponsor or of any other party, including information about a company’s internal structure (including organizational charts and who reports)
Crude, vulgar or offensive language, gang signs and/or symbols
Website or web page links
Trespass or violation of other people’s rights or property
Flooding, spam, chain letters, pyramid schemes, junk mail, etc;
Content attempting to impersonate a third party
Any third party brand taglines
Any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by Sponsor in its sole discretion
It is the sole discretion of the Sponsor and/or its panel of judges to approve your hip hop bar entry for judging.
You may only enter once per Live Local Audition during the contest submission period.
By submitting a hip hop bar entry, Entrant agrees to all these terms and conditions which include: (i) to license to Sponsor the right to use the entry; (ii) Sponsor (or any of Sponsor’s assignees or licensees) shall have the irrevocable, worldwide license to distribute, exploit, publish, or otherwise use the written entry in any and all media and medium whatsoever, the Internet, now known or hereafter created, with the right to edit, modify, or extract any materials, all in perpetuity; (iii) the grant to Sponsor (or any of Sponsor’s assignees or licensees) the irrevocable right to use your name, voice, words, image, and likeness in connection with the entry in the advertising and promotion of the Jack n’ for Beats contest without any further compensation; and (iv) that you agree to waive any and all copyright interest of any nature or kinds that you may have in the written entry, including without limitation any moral rights, and unconditionally assign such rights and interests to Sponsor; (v) agrees to release and hold harmless the Sponsor (or any of Sponsor’s assignees or licensees) against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action related to the submission. By entering, each Entrant acknowledges and agrees the Sponsor may post submissions, or any portion thereof, online, which brings the submission within the public view and Sponsor will not be held liable for any copying, re-posting or unlawful use of the submission including without limitation rights of publicity or privacy, or defamation or portrayal in a false light, whether intentional or unintentional, that may result. The posting of any submission online is at Sponsor’s sole discretion and does not suggest or imply that an Entrant has been selected to win a prize in this contest.
By submitting an entry, you agree to the rules and also expressly represent and warrant that you do not have any obligation (contractual or otherwise) to any third party which may interfere with or prevent you from fully participating in this contest. You agree to waive any right to royalties or other compensation arising from any use of the submissions. All entries become the property of Sponsor.
NO CONFIDENTIALITY: The nature of this contest is interactive and public. By submitting his/her entry, Entrant understands and acknowledges that any materials, ideas or other communications he/she transmits in any manner and for any reason are gratuitous and made without restriction and will not be treated as confidential or proprietary. Furthermore, Entrant acknowledges and agrees that any ideas, concepts, techniques, procedures, methods, systems, video, scripts, music, photographs, designs, plans, charts or other materials Entrant transmits to Sponsors may be disclosed on a non-confidential basis to anyone or otherwise used by Sponsor anywhere, anytime, and for any reason whatsoever without any additional compensation to Entrant. By submitting an entry, Entrants is giving the Entry to Sponsor and Sponsor may, but is not required to use the entry in their sole discretion.
ELIGIBILITY: Employees of Brown-Forman, Jack Daniel’s Tennessee Honey, their respective parents, affiliates, subsidiaries, advertising and promotion agencies, beverage alcohol wholesalers and retailers, as well as their employees, and a judging panel selected by Sponsor (collectively, “Promotion Parties”), and the household members and/or the immediate family of any of the above are not eligible to enter.
The Sponsor(s) may, in its sole discretion, disqualify any Entrant if the Entrant is found to have or alleged to have committed an act which shocks, insults, or offends the community, ridicules public morals and decency, or is charged with any offence (under federal, provincial, or local law) or engages in behavior involving moral turpitude or becomes involved in (or is alleged to have become involved in) behavior which brings or would likely bring the Sponsor, the Jack Daniel’s Tennessee Honey brand, or the contest, into public disrepute, contempt, scandal, or which insults or offends the community based on a reasonable community standard.
Subject to and in accordance with applicable laws, you agree that Sponsor may conduct background checks on you and do research regarding your entry with or without any further communication with you. You agree to execute such additional consent forms as may be required by Sponsor in connection with these background checks and this contest.
JUDGING CRITERIA
Throughout the Contest the Judging Criteria shall be for the Live Local Audition and Local Cypher Event/Grand Finale:
Sponsor and/or the Judging Panel (“Promotion Parties”) will be judging the eligible entries based on the following criteria and the weightings described below. Entries may receive a maximum score of 20 points:
- Originality – maximum score – 5 points
- Creativity –maximum score – 5 points
- Musical Skill – maximum score – 5 points
- Flow – maximum score – 5 points
There is not a limit to how many total entries may be submitted during a Live Local Audition.
Limit one entry per day per contestant.
Judging Panel should judge the entries based on the Judging Criteria!
LOCAL CYPHER/GRAND FINALE QUALIFIERS: Local Cypher Event/Grand Finale
There will be up to twelve (12) Grand Finale Qualifying Entries selected for the Local Cypher Event/Grand Finale. The Qualifying Entries will be the entries that score the highest at each Live Local Audition based on Judging Score: 100%
In the event of a tie, tied entries will be rejudged by Judging panel on the basis of the Judging Criteria If there is still a tie, a random draw will determine the Qualifying Entries.
The Grand Finale Qualifying Entries will be judged by the Judge panel based on their diversity in styles of rap (flow) and their style of playing to the beat. Judges will award points based on the Judging Criteria. Judges will select one Grand Finale Prize Winner.
There will be one Grand Prize Winner. The Grand Prize consists of a Grand Prize Trip to Miami for New Year’s Eve. The Grand Prize Trip includes round trip coach class airfare for Grand Prize Winner and one guest from commercial airport closest to Grand Prize Winner’s home to Miami, FL , two nights hotel accommodation (double occupancy) in hotel selected by Tennessee Honey AND for the Grand Prize Winner and guest a New Year’s Eve Boat Cruise hosted by Rocsi Diaz. The Grand Prize Trip must be taken December 30, 2016 through January 1, 2017. (Grand Prize ARV Three thousand dollars [$3000.00])
ODDS: The odds of winning the Grand Prize depend on the application of Judging Criteria by the Judges.
Value of Grand Prize may vary depending on point of departure.
The Grand Prize Winner will be notified in person on October 7, 2016. Grand Prize Winner will have seven (7) days from date of notification to respond to the notice affirming acceptance of the Grand Prize. Upon acceptance and prior to travel, Potential winner will be required to execute an eligibility release and a liability publicity release. By accepting his or her prize, the winner: (a) releases Brown-Forman/Jack Daniel’s, Promotion Partners and their affiliated companies and licensed alcohol wholesalers and retailers from any all liability claims, action or proceedings arising out of or for injuries or damages sustained while involved in a promotion activity or connection with the use of the prizes; as well as (b) consents to the use by Brown-Forman for promotional and advertising purposes in connection with this promotion and general use, of the images, recordings, and other materials submitted with entries and recorded during the studio session, and of his or her name and/or likeness and/or voice without further compensation.
Any travelling companion of the Grand Prize Winner must be at least 21 years of age and must execute a similar liability/publicity release prior to participating in any trip.
BEVERAGE ALCOHOL IS NOT PART OF ANY PRIZE.
Travelling Companion of Winner will not be allowed to participate in any part of the studio session.
DECLARATION AND RELEASE:
Transportation is not part of any prize or portion of this Contest except for the Grand Prize.
LIMITATION OF LIABILITY: By entering contest, Entrant accepts and agrees to these Official Rules and the decisions of Sponsor, which shall be final in all matters. By accepting prize, Winner agrees to hold Sponsor, Promotion Parties, their affiliates, directors, officers, employees and assigns harmless against any and all claims and liability arising out of use or redemption of prize or participation in the contest including without limitation claims or personal injury or death, infringement of rights of publicity or privacy, or defamation or portrayal in a false light, whether intentional or unintentional. Promotion Parties are not responsible for lost or late entries or Declaration and Releases, or for any typographical, or other error in the printing of the offer, administration of the contest, or announcement of the prize, or for technical, hardware, or software malfunctions, computer virus, bugs, tampering, unauthorized intervention, fraud, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this contest, or by any human error which may occur in the processing of the entries in this contest, or any other cause beyond the reasonable control of Sponsor that interferes with the proper conduct of the contest as contemplated by these Official Rules. If, in the Sponsor’s opinion, there is any suspected or actual evidence of tampering with any portion of the contest, or if technical difficulties or any other factor including accident, printing, administrative, or any error of any kind compromises the integrity, administration, or conduct of the contest, the Sponsor reserves the right to modify, cancel, or suspend this contest without prior notice or obligation. Any attempt to deliberately damage any website or to undermine the legitimate operation of this contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
Sponsor reserves the right to disqualify a person if he/she enters the contest or tries to do so by any means contrary to these rules or which would be unfair to other entrants or where contest entries are generated by any mechanical or automated means. Entry materials that have been tampered with, reproduced, falsified, or altered are void. In the event a dispute arises as to the identity of a potentially winning online entrant, entries made by internet will be declared made by the name on the online entry form.
Currency is in US dollars unless otherwise stipulated. The prize will be delivered only to the confirmed Winner. Winner is responsible for all federal, state and local taxes on the prize. A tax document may be issued and will be issued to the Grand Prize Winner.
No substitution or transfer of Prize is permitted.
Refusal to accept a prize releases the Promotion Parties, as well as their respective directors, officers, and employees, of all responsibility and obligations toward the Winner of such prize. In no event shall Sponsor be held to award more prizes that what is mentioned in these rules or to award prizes otherwise than in compliance with these rules. If a Winner cannot attend any future part of the Prize he/she forfeits that part of the Prize.
CONDITIONS OF ENTRY: Acceptance of a prize constitutes permission for the Sponsor, and their agencies to use Winners’ names, cities and states of residence and likenesses, for purposes of advertising and publicity in any and all media now or hereafter known throughout the world in perpetuity, without further compensation, notification, or permission, unless prohibited by law.
All information requested by and supplied by each Entrant must be truthful, accurate, and in no way misleading. Sponsor reserves the right to disqualify any Entrant from the contest in their discretion, should the Entrant at any stage supply untruthful, inaccurate, or misleading details and/or information or should the Entrant be ineligible for the contest pursuant to these rules.
PRIVACY: Brown-Forman respects Entrants’ right to privacy. Entrants’ names, addresses, telephone numbers, and e-mail addresses are gathered for the purpose of administering this contest. By entering the contest, Entrants consent to Brown-Forman collection, use, and disclosure of their personal information for these purposes.
